Special Education

Cohen & Sales, LLC advises and represents families with children with special needs and disabilities with respect to federal and state laws governing their rights to special education and reasonable accommodations, and to be free from harassment and discrimination.

We assist parents and students by consulting with them for advice and strategy to maximize the benefits of a child’s Individualized Education Plan (IEP), through alternative dispute resolution, and hearings and appeals. We provide advocacy and representation in administrative hearings before the Bureau of Special Education Appeals (BSEA), and appeals and litigation before state and federal courts. This work includes assistance with determinations of eligibility for an IEP, and working towards the most appropriate special education services, in district placements, or, if necessary, securing public funds for an out of district or private school placement.

We also advise with, consult and represent families regarding their rights under Section 504 of the Rehabilitation Act, including Section 504 Plans.  This assistance can be critical for families with children with disabilities who are not eligible for an IEP, but yet require an accommodation for a disability to “level the playing field.”

Cohen & Sales, LLC also has extensive litigation experience in representing children and adults with disabilities in protecting against discrimination based on their disabilities.   We represent families with children with disabilities who have been the victim of bullying, harassment based on a disability, or discriminatory treatment and failure to accommodate a disability.
